General Terms & Conditions

The client and Sweet Boy Bakery (the “Parties”) mutually agree to the following terms of this contract. Any changes to any of the following terms will be upon mutual consent of both Parties.

Delivery 

1. Delivery is defined as the handing over of a finished product to the client, and as such may occur when the product is picked up by the client or when the product is physically delivered to the client. 

2. Ownership and responsibility for all products transfer from Sweet Boy Bakery to the client once delivery has occurred. If the product is physically delivered to the client, Sweet Boy Bakery will not remain on-site after delivery. 

3. Sweet Boy Bakery is not responsible for unforeseen circumstances, such as inclement weather, accidents, labor disputes or strikes, or any other causes beyond the control of Sweet Boy Bakery, which may result in a delay in transit or delivery. A delay in transit or delivery does not constitute grounds for a discount or refund. 

4. Sweet Boy Bakery may choose to advise the client on the best care for the products depending on the weather; however, it is the responsibility of the client to follow this advice. Sweet Boy Bakery shall not be responsible for any damage to any products resulting from disregarded advice. 

5. Sweet Boy Bakery shall not be responsible for providing plates, cutlery, napkins, cutting and serving knives, cake stands or for cutting the cake itself. 

Payment, Prices and Cancellation – Weddings and Other Large Events

1. A deposit of 50% of the total price is required to secure the delivery date. The remaining balance is due two (2) weeks prior to the delivery date. 

2. If the contract is cancelled by the client two (2) weeks prior to the delivery date, then 50% of the deposit will be refunded. If the contract is cancelled by the client less than two (2) weeks prior to the delivery date, then the client forfeits the entirety of the deposit. 

3. Any changes to the design requested by the client after payment of the deposit may result in additional charges. Acceptance of proposed changes are subject to approval by Sweet Boy Bakery and may be refused if in Sweet Boy Bakery’s discretion that they would interfere with the quality of the finished product. 

4. Any changes to the order are subject to availability and must be mutually agreed upon in writing no later than three (3) weeks prior to the delivery date. 

Payment, Prices and Cancellation – All Other Cakes and Products

1. A non-refundable deposit of 50% of the total price is required to secure the delivery date. The remaining balance is due one (1) week prior to the delivery date. 

2. If the contract is cancelled by the client with less than one (1) week until the delivery date, then the client forfeits the entirety of the price of the product(s). 

3. Any changes to the design requested by the client after payment of the deposit may result in additional charges. Acceptance of proposed changes are subject to approval by Sweet Boy Bakery and may be refused if in Sweet Boy Bakery’s discretion that they would interfere with the quality of the finished product. 

4. Any changes to the order are subject to availability and must be mutually agreed upon in writing no later than one (1) week prior to the delivery date. 

Liability 

1. Sweet Boy Bakery is not responsible for damage to the cake caused by a guest, caterer, or any person not employed by Sweet Boy Bakery. Furthermore, Sweet Boy Bakery is not responsible for environmental conditions which may result in damage to the cake. The client agrees to make arrangements for an appropriate and secure environment for the cake. 

2. The client is responsible for removal of all non-edible cake decor from the cake prior to cutting and serving. 

3. Sweet Boy Bakery’s products may contain or come into contact with milk, nuts, wheat or other allergens. The client is responsible for informing Sweet Boy Bakery of any known allergies. Sweet Boy Bakery shall not have any liability for damages caused by allergies which were not disclosed by the client prior to ordering. Further, it is the responsibility of the client to inform guests of possible allergens. 

Complaints 

1. If the client has a complaint about a delivered product, the complaint must be made in writing no more than two (2) days after delivery. Any complaints will be addressed entirely at the discretion of Sweet Boy Bakery on a case-by-case basis. 

Other 

1. Sweet Boy Bakery reserves the right to use any photos of the finished cake for promotional use. The client shall not be compensated for such use. 

2. Sweet Boy Bakery reserves the right to make last-minute design changes in order to maintain a standard of quality. Images provided to Sweet Boy Bakery for design wishes are intended only to serve as inspiration and not the basis for a complete replication.

3. Cake slices are based on the standard 2 1/2 cm x 5 cm x 10 cm (l/ w/h) size. Sweet Boy Bakery is not responsible for too few or too many servings of cake when the slices are not cut to this size.
